TERMS OF SERVICE
1. ACCEPTANCE OF TERMS
By accessing, browsing, or utilizing any services provided by Find Your Home ("Company," "we," "us," or "our"), you ("Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Find Your Home.
If you do not agree to these Terms in their entirety, you must immediately discontinue use of our services. Your continued use of our services following any modifications to these Terms constitutes acceptance of such modifications.
These Terms apply to all users of our services, including without limitation users who are browsers, clients, and any other parties who access our services.
2. SERVICE DESCRIPTION
Find Your Home provides guided home search support services designed to assist prospective property buyers in identifying, evaluating, and pursuing suitable real estate opportunities. Our services specifically include:
Guided Home Search: Personalized consultation and direction to help clients navigate the property market, identify properties matching their criteria, and understand market dynamics relevant to their search.
Property Shortlist & Comparison: Assistance in narrowing property options, creating shortlists of suitable properties, and providing comparative analysis to support informed decision-making.
Offer Strategy Guidance: Advisory services regarding approach and strategy for making offers on properties, including market positioning and competitive considerations.
The Company provides guidance and support services only. We do not act as licensed real estate agents, brokers, mortgage lenders, legal advisors, or financial advisors unless explicitly stated otherwise. Our services are educational and consultative in nature and are intended to complement, not replace, the services of licensed professionals.
The Company does not guarantee that clients will successfully locate or purchase any property. Market conditions, competition, financing, and numerous other factors outside our control affect real estate transactions.
Services may be provided through various channels including in-person meetings, telephone consultations, video conferences, email correspondence, and online platforms, as determined appropriate for each client engagement.
3. USER OBLIGATIONS
By using our services, you agree to:
Provide accurate, current, and complete information about yourself and your property search requirements as requested by the Company.
Maintain the confidentiality of any account credentials or access information provided to you and notify us immediately of any unauthorized use.
Use our services only for lawful purposes and in accordance with these Terms and all applicable local, state, national, and international laws and regulations.
Treat Company representatives, staff, and associated professionals with respect and professionalism during all interactions.
Refrain from using our services to transmit any material that is unlawful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
Not attempt to gain unauthorized access to any portion of our services, systems, or networks.
Not reproduce, duplicate, copy, sell, resell, or exploit any portion of our services without express written permission from the Company.
Acknowledge that you are solely responsible for your own real estate decisions and that you will conduct appropriate due diligence, retain qualified professionals as needed, and make independent judgments regarding any property transaction.
Disclose any conflicts of interest, existing relationships with real estate professionals, or other circumstances that may impact the service relationship.
Provide timely responses to Company communications and requests for information necessary to deliver services effectively.
4. APPOINTMENT SCHEDULING AND CANCELLATIONS
Appointment scheduling for consultations and service sessions is subject to availability and must be arranged through the Company's designated scheduling processes.
Clients are expected to arrive punctually for scheduled appointments. The Company reserves the right to shorten or reschedule appointments when clients arrive late, and late arrival does not entitle clients to extensions of scheduled time.
Cancellation Policy: Clients must provide at least 24 hours advance notice to cancel or reschedule any appointment. Cancellations made with less than 24 hours notice may result in forfeiture of the appointment or assessment of cancellation fees as specified in your service agreement.
No-show Policy: Failure to attend a scheduled appointment without prior notice constitutes a no-show and may result in forfeiture of the appointment and any associated fees.
The Company reserves the right to cancel or reschedule appointments due to emergencies, illness, or unforeseen circumstances. In such cases, we will make reasonable efforts to provide advance notice and reschedule at a mutually convenient time.
Repeated cancellations, no-shows, or late arrivals may result in termination of the service relationship at the Company's discretion.
5. PAYMENT TERMS
Pricing for services will be communicated to clients prior to engagement and may vary based on service scope, duration, and specific client needs.
Payment is due according to the schedule specified in your service agreement. Unless otherwise specified, payment is required in advance of service delivery.
Accepted payment methods will be communicated during the engagement process. The Company reserves the right to modify accepted payment methods at any time.
All fees are quoted in United States Dollars unless otherwise specified. Clients are responsible for any currency conversion fees, bank charges, or transaction fees associated with payment processing.
Refund Policy: Fees paid for services already rendered are non-refundable. For prepaid services not yet delivered, refund eligibility will be determined based on the specific circumstances and the terms of your service agreement.
Late Payment: Overdue payments may result in suspension of services, assessment of late fees, and referral to collections. Clients remain responsible for all costs of collection, including reasonable attorney fees.
Price Changes: The Company reserves the right to modify service pricing at any time. Price changes will not affect services already purchased or under existing service agreements, but will apply to future service purchases.
Clients acknowledge that Find Your Home's services are separate from and not contingent upon any real estate transaction, and fees are earned for guidance and consultation services provided regardless of whether clients ultimately purchase property.
6. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Find Your Home, its owners, employees, contractors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses resulting from:
Your access to or use of or inability to access or use our services.
Any conduct or content of any third party in connection with our services.
Any property you view, evaluate, or purchase in connection with our services.
Any real estate transaction or investment decision you make.
Unauthorized access to, use of, or alteration of your transmissions or content.
In no event shall Find Your Home's total aggregate liability to you for all damages, losses, and causes of action exceed the amount paid by you to Find Your Home for services in the six months preceding the claim.
The Company provides guidance and information services only. We are not responsible for:
The accuracy, completeness, or reliability of property listings, market data, or information provided by third parties.
Property defects, title issues, zoning restrictions, environmental conditions, or other property-related matters.
Changes in market conditions, property values, or investment performance.
Financing denials, qualification issues, or lender decisions.
Actions or omissions of real estate agents, sellers, inspectors, appraisers, lenders, attorneys, or other third parties.
Your interpretation or application of guidance provided.
Decisions you make regarding property searches, offers, or purchases.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
7. WARRANTY DISCLAIMERS
Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Find Your Home does not warrant that:
Our services will meet your specific requirements or expectations.
Our services will be uninterrupted, timely, secure, or error-free.
Any information, guidance, or recommendations provided will be accurate, reliable, or complete.
You will successfully locate or purchase any property.
Property values will increase or maintain their value.
Any defects in our services will be corrected.
The Company makes no representations or warranties regarding the quality, suitability, or condition of any properties you may view or consider. You acknowledge that purchasing real estate involves substantial risk and that you are solely responsible for conducting appropriate due diligence, including but not limited to inspections, title searches, environmental assessments, financial analysis, and legal review.
Market conditions, property values, and real estate dynamics are subject to change and involve inherent uncertainty. Past performance and historical data are not guarantees of future results.
Any material downloaded or otherwise obtained through use of our services is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from downloading such material.
No advice or information, whether oral or written, obtained by you from Find Your Home or through our services shall create any warranty not expressly stated in these Terms.
8. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and any disputes arising out of or related to these Terms or our services shall be governed by and construed in accordance with the laws applicable in our jurisdiction, without regard to conflict of law principles.
Any disputes, claims, or controversies arising out of or relating to these Terms or our services shall be resolved through good faith negotiation between the parties. Both parties agree to make reasonable efforts to resolve disputes amicably before pursuing formal legal action.
Each party agrees that any cause of action arising out of or related to our services must commence within one year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
You agree to indemnify, defend, and hold harmless Find Your Home, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services.
9. INTELLECTUAL PROPERTY
All content, materials, information, and intellectual property provided through our services, including but not limited to text, graphics, logos, analysis tools, reports, methodologies, and software, are the property of Find Your Home or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use our services and materials solely for your personal, non-commercial use in connection with your property search.
You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from our services without prior written consent from Find Your Home.
10. TERMINATION
Either party may terminate the service relationship at any time with written notice to the other party. Termination does not relieve you of obligations to pay for services already rendered.
The Company reserves the right to suspend or terminate your access to services immediately, without prior notice or liability, for any reason, including but not limited to:
Breach of these Terms.
Provision of false or misleading information.
Abusive, threatening, or inappropriate conduct toward Company representatives.
Non-payment of fees.
Engagement in fraudulent or illegal activities.
Upon termination, your right to use our services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to warranty disclaimers, limitations of liability, and dispute resolution provisions.
11. CONFIDENTIALITY AND PRIVACY
The Company respects your privacy and will handle your personal information in accordance with applicable privacy laws. Information you provide will be used solely for the purpose of delivering services to you.
You acknowledge that during the course of our service relationship, you may receive or become aware of confidential information regarding our business methods, strategies, and proprietary processes. You agree to maintain such information in confidence and not disclose it to third parties.
While we implement reasonable security measures, you acknowledge that no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security of information.
12. THIRD-PARTY SERVICES AND LINKS
Our services may contain links to or integrate with third-party websites, services, or resources that are not owned or controlled by Find Your Home. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
You acknowledge and agree that Find Your Home shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any third-party content, goods, or services.
Your interactions with real estate agents, brokers, lenders, sellers, and other third parties encountered through or in connection with our services are solely between you and such third parties. You agree that Find Your Home will not be responsible or liable for any loss or damage incurred as a result of such interactions.
13. CHANGES TO TERMS
Find Your Home reserves the right to modify or replace these Terms at any time at our sole discretion. Changes will be effective immediately upon posting to our website or notification to clients.
Your continued use of our services following the posting of revised Terms constitutes your acceptance of such changes. It is your responsibility to review these Terms periodically for updates.
If you do not agree to the modified Terms, you must discontinue use of our services.
